"You" and "your" refer to any person or entity using the Service. "User Content" means any text, images, code, configuration, messages, files, or other materials you provide through the Service.
These Terms of Service ("ToS") form a legally binding agreement between you and the operators of the Service. By accessing or using the Service in any manner, including but not limited to visiting or browsing the website, interacting with the Bot on Discord, or using any related tools, you agree to be bound by these ToS and any policies referenced herein. If you do not agree to these ToS, do not access or use the Service.
We may modify these ToS from time to time. Material changes will be indicated by updating the "Last Updated" date and, where feasible, providing notice through the Service or other reasonable means. All fees are non-refundable except as required by law or as expressly stated in the purchase terms. We may change pricing or add/remove features at any time; changes to paid plans will not affect funds already paid for a completed billing period unless otherwise stated.
The Service and its original content, features and functionality, including but not limited to code, designs, graphics, and trademarks, are and will remain the exclusive property of the Bot developers and its licensors. Nothing in these ToS grants you any right to use our trade names, trademarks, logos, domain names, or other distinctive brand features without our prior written consent.
The Service may contain links to third-party websites, integrations, or services. We do not endorse and are not responsible for third-party content, privacy practices, or terms. Your use of third-party services is subject to their terms and policies.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE BOT DEVELOPERS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM THESE TO S WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
You agree to defend, indemnify, and hold harmless the Bot developers, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with (a) your access to or use of the Service, (b) your User Content, (c) your violation of these ToS, or (d) your violation of any rights of a third party.
We may suspend or terminate your access to the Service, or remove your User Content, at our sole discretion, without prior notice, for any reason, including for violation of these ToS or for conduct that we believe is harmful to other users or to the operation of the Service. Upon termination, your right to use the Service will cease immediately.
These ToS will be governed by and construed in accordance with the laws of the jurisdiction in which the Bot developers are located, without regard to conflict of law principles. For disputes that cannot be resolved informally, the parties agree to submit to the exclusive jurisdiction of the state and federal courts located in that jurisdiction, unless otherwise required by applicable law.
Notwithstanding any other provision of these ToS, we may seek injunctive or other equitable relief to prevent or restrain breaches of these ToS or to protect our intellectual property, confidentiality, or other proprietary rights without posting a bond or proving actual damages.
If any provision of these ToS is held to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these ToS will not be deemed a waiver of such right or provision.
We may provide notices to you via the Service, by email, or by posting notices on our website. Notice to us should be sent through the support channels linked below.
These ToS, together with any documents expressly incorporated by reference (including the Privacy Policy), constitute the entire agreement between you and the Bot developers regarding the Service and supersede all prior and contemporaneous understandings, proposals, or representations, written or oral.
